Hey!
OMG! Just realised that we didn't get around to making Australian Wills as planned :doh: Now it's just that Rob's away on a 'manly' 4WD/ fishing weekend thing and my brain started working overtime :sign68: :o
Do U.K wills have any legal standing here? especially that we now have an extra sproglet (changed circumstances)
Where's the best place to get this fixed first thing Monday morning?

This is terrible but me and hubby dont have wills yet!! Should we do them now, or wait until we get to Adelaide?!

No, different rules here Jan for dispersement of assets on death - you need to get an Australian will drawn up sharpish :D
You can get DIY wills from the Post Office, easy enough to do and perfectly legal, but given your 'extended' family you may be wise to get one drawn up by a solicitor. I'd do it for you, but am not legally entitled to practice til I finish my professional quals in November. ;)

p.s. Lucy, I'd get a DIY one in the UK if your requirements are straightforward (much cheaper) and then get an Aus one drawn up upon arrival.

sorry but can i add...if we do do a DIY here in oz and we want to leave stuff to family in UK (gob forbid we all go! :sign68: ) will they get it?, i mean does it have as much legal standing as one done by a solicitor?, if you get what im trying to say.
im glad this was bought up as i hadnt forgotten it too! :doh:

Yes, it does have legal standing Tan (presuming it's witnessed correctly) so your UK rellies will be fine :)

Not been on here in ages but this will business is somewhat of
a nightmare. We have been told by friends that our will is not
valid in Oz and that we have to make a new one to be signed
by a GP??? We are going next friday to see a solicitor to confirm
that this is true. So I will post any questions and answers that
I get on here next week. (That's if I have not popped off by
then)!!! ;)
I am sure that if I did, my family would strongly protest
any government grabbing all my assets!! I also enquired
about organ donation as I had a card in UK. When I got my
driving license they did not ask me about donation?? There
is a new organisation now that you can join for organ donation
when I get the details I will also post on here.

Just make absolutely sure that in any will you give clear instructions on guardianship of minors, especially if you have no relatives in Australia.

heres one....where would they live?, would they have to go back to UK if they are oz citizens(the child) and the rellie was there?, i suppose i would hope that these rellies would be allowed to live here to look after the child!!????.(if so we have an option here thats all)

When my kids were minors my closest relative was (and still is) in New Zealand. Both she and I made provisions for our children to go to each other as guardians should anything untoward happen to us as parents. Children can become wards of the State if nothing is in writing, and would then be placed in some sort of care under guardianship of the State.

Our wills were pretty complicated anyway what with Liam. We have no-one in our families for our kids to go to but wanted Robs Sister to help choose foster/adoptive parents....but she has kind of disowned us :( So I suppose if we were Citizens they will be in the hands of the Oz Govt. Hopefully it won't ever come to that, but I'd like them to stay in Oz whatever.
