Title: TRA - what is a statutory declaration?
Liz - February 21, 2007 09:15 AM (GMT)
Hi everyone,
I've printed off the intructions from the TRA to make sure we get it right first time. My husband's job is a bit unstable at the moment, so he doesn't want to let his employer's know of our plans, because if they are getting rid of people i'm sure they would pick him as he is planning to leave in the future anyway. So, i've copied a bit from the TRA below, but I don't know what a Statutory declaration is, can anyone enlighten this numbskull please?
It goes something like:
If you are reluctant to approach your employer for a statement of your employment, you can submit personal statement on a properly signed and witnessed Statutory declaration.

hi,
my hubby was in the same situation, we spoke to a local solicitor and he said a stat dec is a statement you write and sign as true - it needs to be signed and witnessed by a solicitor.
If you ring your local solicitor they can tell you how to lay it out and then you can take it in there to be signed and witnesses for a fee.
This was okay for one of his jobs but i don't think it would work for very more than that to pass the TRA (might be wrong tho!)
What does he do anyway, if you don't mind me asking?
Jo.

We had to do quite a few stat decs for our TRA so pm me if you would like a copy to see what it is. It is an official statement that is witnessed by a solicitor.

Hi to you to Hayhay!
My husband is a telephone engineer, we have approached BT for his personal files (he left them in 1990, so fingers crossed!) He has been a contractor ever since. The other contracting companies shouldn't be a problem it's just the one that he currently works for. They work in 3 gangs, and they are threatening that a gang will have to go, so if they knew about our plans it would make their life a lot easier!
Thanks Jo and Lisa, I had a feeling it would involve solicitors and money
I'll pm you Lisa x

Hi a statatury declaration is a statement saying who you are and declaring that all info given is true. it must be signed and witnessed by a solisitor. This is what we had to put;
I (your name) born on the(d.o.b), currently of (your adress) do solemnly and sincerely declare that the following statement is a true and accurate account of my position as (your job title).
you then write your statement with as much detail as possible
I make this solemn declaration by virtue of the statutory declaration act 1835 and subject to the penalties provided by the act for the making of false statements in statutory declarations, conscientiously believing the statements contained in this declaration to be true in every particular.

Hi, we got our solicitor to do all of our certified copies and prepare a stat dec, but she said that as she had prepared it she wasn't allowed to witness me 'swear' it so said to go to the other local solicitor. I called them and they saw me within a couple of hours, took less than a minute and they charged me £5 quid!
I think all the terminology is quite daunting but once you get into it it's more straight forward than you think. Both solicitors had done certifiying and stat decs for many people hoping to emigrate so they know what it's all about.
Good luck.

Ashley only did one stat dec, he took his passport along to a solicitor & then swore an affadavit that he is who he is, its cost about £10 & took no more than 10 minutes - we spent most of the time waiting for the solicitor to find a stamp so he could date & sign the document plus we had to send his business card along to the agency to :sign60:
Good luck
